Avery Dial

Avery Dial focuses his practice on commercial, professional liability (including directors & officers, attorneys, accountants, medical professionals, nursing homes and other long-term care facilities, hospitals, and architects & engineers), insurance coverage, labor and employment, data privacy, intellectual property, product liability and wrongful death litigation.

Dial, the former chair of a national firm’s Cybersecurity and Data Privacy practice group, advises and litigates on behalf of technology companies in the space of internet advertising, software development, and database maintenance. Also, Dial defends businesses and professionals accused of data breach and privacy violations. Further, Mr. Dial advises companies in a variety of industries on pre and post data breach practices.

Mr. Dial defends and prosecutes business matters including employment, breach of contract, civil theft, conversion, breach of warranties, statutory violations, fraudulent business practices, professional malpractice, intellectual property, defamation, and entertainment matters.

Mr. Dial represents clients in all areas of employment litigation, including discrimination, harassment, retaliation, and sexual assault including any matters arising under the Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and the Family and Medical Leave Act (FMLA). Further, Dial litigates matters involving non-compete, non-solicitation, and theft of trade secrets.

Dial litigates insurance coverage matters in all lines and specialties including general and professional liability, property (commercial, residential, aviation), bonds, and credit risk.

Mr. Dial counsels and defends private businesses and municipalities on website and brick and mortar accessibility claims under Titles II and III of the Americans with Disabilities Act. He also counsels and defends clients on actions brought under the Fair Housing Act.

Mr. Dial is an experienced litigator for commercial and residential real estate matters including title claims, foreclosures, landlord tenant disputes and breaches of contract on behalf of title insurers, banks, tenants, and property owners.
